Use of our services and/or purchase of our products will imply that you have read and accepted these conditions. Some of the products offered through our website may be created, charged, delivered or presented by a third-party site and in that case will be subject to their own terms and conditions.
In some cases, registration of the user with truthful personal data and definition of a password will be required to acquire a product. The user may choose and change the password for their account administration access at any time, where they have registered and where this is necessary for the use of any of our services. VOIPER TELECOM, S.L. assumes no liability if the user shares such password with third parties.
All transactions carried out through this website are subject to a confirmation and verification process which may include validation of the payment method, validation of the invoice (where applicable) and compliance with the conditions required by the chosen payment method. In some cases verification by email may be required.
The prices of the services offered on this website are valid only for subscriptions taken out on it.
Licence
VOIPER TELECOM, S.L., through its website, grants users a licence to use the services offered on it in accordance with the conditions described in this document.
Unauthorised use
VOIPER TELECOM, S.L. grants the user a limited, personal and non-transferable licence to use the services and VoIP telephony platform. The resale, redistribution, sublicensing or transfer to third parties of services, phone numbers, SIP extensions or any other resource assigned to the customer is expressly forbidden without prior written authorisation from VOIPER TELECOM, S.L.
Ownership
The contents, design, source code, brand, logo and other elements of the website are owned by VOIPER TELECOM, S.L. or its licensors and are protected by Spanish and international intellectual and industrial property law. Their reproduction, distribution, public communication or transformation is expressly forbidden without prior written authorisation.
Refund and warranty policy
VOIPER TELECOM, S.L. services are provided in SaaS (Software as a Service) subscription mode. The user may exercise the right of withdrawal within 14 calendar days from contracting, provided that performance of the service has not started with their express consent. If the user requests the immediate start of the service during that period, they waive the right of withdrawal under art. 103.m of Royal Legislative Decree 1/2007 (TRLGDCU).
Beyond the withdrawal period, no refunds will be made for subscription periods already invoiced. Subscriptions may be cancelled at any time, taking effect at the end of the current billing period during which the service will remain active.
- The right of withdrawal must be exercised in writing to info@thesiphouse.com within 14 calendar days of contracting.
- Number portability costs incurred are non-refundable.
- Configuration, integration or implementation services delivered to customer specifications are non-refundable once completed.
In case of service interruptions or failures attributable to VOIPER TELECOM, S.L., the compensation regime laid down in the particular service conditions and in Spanish General Telecommunications Law 11/2022 and its implementing regulations applies.
Limitation of liability
To the extent permitted by applicable law, in no event shall VOIPER TELECOM, S.L. be liable for indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or related to the use or inability to use the service.
To the extent permitted by applicable law, VOIPER TELECOM, S.L. assumes no liability for:
- Errors or content inaccuracies.
- Personal injury or property damage, of any nature, resulting from access to or use of the service.
- Any unauthorised access to or use of our servers and/or any personal information stored on them.
Anti-fraud verification
Purchase or contracting may be delayed for anti-fraud verification. It may also be suspended for a longer period where a more thorough investigation is necessary to prevent fraudulent transactions.
Privacy
VOIPER TELECOM, S.L. guarantees that personal information provided by the user will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPD-GDD). Data may be communicated to third-party companies providing services necessary for the development of the activity, on the terms detailed in the Privacy Policy. Subscription to commercial email newsletters is voluntary and can be selected when creating your account.
Right to amend the legal notice and terms of use
VOIPER TELECOM, S.L. reserves the right to modify these terms without prior notice. Therefore, we recommend that you review these pages periodically. Where the legal notice and terms of use are materially amended, we will notify the changes through the email address you provided, with 30 days' notice before the new terms take effect. Continued use of the website or service after such change constitutes acceptance of the new legal notice and terms of use.
Governing law and dispute resolution
This legal notice and terms of use are governed by Spanish law. For business (B2B) relationships, any dispute is submitted to the Courts and Tribunals of Málaga. For users acting as consumers (B2C), the jurisdiction of the consumer's domicile applies under art. 52 LEC and the TRLGDCU.
